
Booking Terms & ConditionsTHIS IS A CONTRACT BETWEEN YOU AND HOLIDAY HOMES INTERNATIONAL LTD (“HHI” )OF 6-8 UNDERWOOD STREET, LONDON N1 7JQ (Company Registration No. 05634012) (1) The Rental ContractAs the person entering into this agreement, you are doing so on behalf of all those persons travelling with you. It is assumed – and you are confirming – that you have their authority to agree to the terms of these booking conditions. HHI is entering into this contract as agent for the owner of the property you are renting, not as a tour operator or travel agent. Your reservation is of a privately-owned property from an individual or corporation, for whom HHI work as a rental agent and to whom the rental payments, less a commission, are forwarded. This contract is governed and binding by English Law and in the event of any legal dispute arising out of this agreement, we agree to be under the jurisdiction of the English Court.(2) The Agreed Rental PriceAll prices quoted, unless otherwise agreed, are in Euros. On making a reservation for a property offered by HHI, you will be required to send or deposit a down-payment to the HHI bank account specified within 3 days of receiving our confirmation. The amount of the down-payment will be between 100 and 250 Euros per week or part-week booked. The balance of the rental amount will then be due one month prior to the first date of the rental period reserved and, unless otherwise agreed, must be paid into the HHI account. If the down-payment is not paid in time, the rental-term at the property reserved will be released for re-sale. If the balance is not paid in time, HHI has the right to cancel the reservation and retain the down-payment. The agreed cost of your reservation, once agreed, is final and is not subject to surcharges for any reason other than if the rental term of the reservation is changed or supplements are requested by you No 'Damage Deposit' or 'Breakage Charge' is made prior to departure unless your reservation is for 3 night or less, in which case a security deposit of up to 500 Euros will be required. We reserve the right however to charge you – and you agree to pay within 14 days of your departure - for any loss or damage (over and above normal wear and tear) caused to or in the property during your stay and as reported to us following your check-out on the day of departure by the on-site property manager. If paid, the security deposit will be refunded to you, less any deductions as outlined above, within 14 days. (3) Changes to Your BookingIf, after we have confirmed the reservation to you, you wish to change your booking in any way, for example your chosen arrival and/or departure date and/or the property reserved, we will do our best to accommodate and make the change(s), for which there will be no charge, but cannot guarantee that they will be possible. If not possible, the original reservation remains in place unless you decide to cancel, in which case the conditions in Clause 4 below will apply. The price of the amended reservation will be re-confirmed to you along with a new balance amount. The terms and conditions will otherwise remain the same and the new reservation will be bound by them in the same way.In the unlikely event that we can no longer provide to you the property reserved (for example, if the owner decides to no longer rent out the property, sells the property, or if the property becomes uninhabitable due to a major maintenance problem), then an alternative property will be offered to you at a cost not to exceed the original rental amount agreed. In this event, and if you so choose, you have the right to refuse the alternative and if you do so within 3 days you will receive a full refund of all monies paid. Should we not be able to offer an alternative property then we will make a full refund to you plus 10% of the rental amount agreed. Force Majeure: - This means that if your reservation has to be changed or cancelled in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances that may amount to force majeure then we are not bound to offer an alternative property to you nor can we guarantee the return of your rental payment. (4) If You Cancel or Curtail Your ReservationYou, or any member of your party with your authorization, may cancel your travel arrangements at any time. Written notification from the person who made the reservation, or the person with such authority, is required.If you cancel up to two months prior to your arrival date then you will receive a full return of your down-payment. If you cancel between two months and one month prior to your arrival date then you forfeit the down-payment. If you cancel within one month of your arrival then it is possible that you will forfeit the entire rental amount unless you or HHI can find alternative clients for part or all of the original period of time reserved by you, in which case you will receive whatever net rental payment is received from them. If you do not use the property you have reserved and paid for or if you depart earlier than agreed, no refund can be made. Note: If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim the payments lost. (5) If You Have A Complaint In the unlikely event you should have a problem with the property you have booked, it is imperative that you report it immediately to our local representative or agent. If you are unable to contact them you should contact HHI. If this is done verbally then confirmation in writing should be received as soon after as possible. Our local representative or agent must be given the opportunity to resolve any issues allowances be made by you for any local conditions regarding the reasonable amount of time taken to rectify the problem. Claims for compensation can only be considered where it is proven that any reported problem had a prolonged or major impact on the enjoyment of the property booked. It is not acceptable to make complaints after departing the property, depriving us of the opportunity to rectify the problem you have encountered. If your complaint is not able to be resolved locally, please write to HHI with the relevant information. We agree to respond to you within 21 days. (6) Personal Injury During Your StayIf you, or any member of your party, suffer death, illness or injury whilst at the property you have reserved with us, we shall, on behalf of the property owner, offer advice, guidance and assistance. If your injury is in your opinion caused by a deficiency at the property and you feel that you wish to make a legal claim, your claim must be made against the owner of the property, not HHI. HHI are not guaranteeing the suitability of the property you have reserved to your requirements and/or expectations.
